Passing Bad Checks

The economic downturn has caused many people much heartache. Jobs, homes, savings, and finances have all been lost. Revised Statutes of Missouri RSMO §570.120, states if you write a check from an account that has insufficient funds, you must make sure the amount is paid in full plus the administration fee, which may be up to 10% of the value of the check, within 10 days or you may be charged with a crime. If the check was written for under $500 you will be charged with a class A misdemeanor which may lead to a sentence of up to one year in the County Jail and/or a $1000 fine. If the check was written for over $500 you may be charged with a class C Felony which may lead to a sentence of up to 7 years in the Department of Corrections and/or a $5000 fine. If you write a check from a fictitious bank account or from a closed bank account you may be charged with a class C Felony regardless of the amount of the check.
