Things to Remember Following a Vehicle Accident

Things are often moving fast and there is often a lot of confusion following a vehicle accident. Below are a few key things that a victim of an accident can do to protect his or her rights following a car, truck or vehicle accident:

  • Ensure the safety of others and determine if any passengers are injured. Call 911 or an ambulance as soon as possible to help in the aid of injury victims. Avoid moving injured passengers if at all possible to avoid more severe injuries.
  • Contact the police to report the accident and allow for the filing of a police report. Even when an accident may initially appear minor, contact the police to document the accident. Some injuries do not manifest until days after the accident.
  • Obtain as much information as possible following an accident while still at the scene. The information that you obtain should include the following: name, address, driver’s license number, phone number, registration, and insurance information of any and all drivers involved in the accident. Also be sure to obtain the name and address of the owner of any and all vehicles involved in the accident.
  • Name, address and phone number of any and all witnesses to the accident or persons who later arrived at the accident scene.
  • Name, badge number, department location, and business card of responding police officers who arrived at the accident scene.
  • Document any traffic tickets issued by police at the scene of the accident.
  • Note the make, model and license plate number of all cars involved in the accident.
  • Make a diagram of the accident scene and write down a description of how the accident occurred. Note any skid marks made on the roadway following the accident.
  • Note the weather and road conditions at the time of the accident.
  • Note all injuries that you and your passengers experienced following the accident.
  • Be sure to take photographs of the scene of the accident. Many cell phones now have cameras making it possible to visually document the angles and locations of the accident and visually replicate damage to vehicles and persons immediately following an accident. Be sure to photograph vehicle damage, injured drivers and passengers, skid marks on the roadway and the roadway or intersection where the accident occurred.
  • Be sure to document any injuries that are incurred following an accident and the progression of those injuries. Be sure to make a detailed list of all injuries, location of pain and the types of pain that you are experiencing, even if it seems to be minor at the time.
  • Make sure to not leave the scene of an accident, unless being transported to the emergency room by ambulance. Be sure all other drivers, witnesses, and police have left prior to leaving the accident scene.
  • Seek necessary medical attention including possible emergency room and follow-up medical care immediately following the accident.
