Equitable Distribution of Property

Property division is often the most problematic divorce-related issue a couple faces. When couples own high value assets, the process becomes even more complicated. At The Roberts Law Firm, P.C., we work with clients to examine all of the angles of their property division case.

In Missouri, the equitable distribution of property is followed. Unlike a 50/50 split of assets, equitable distribution considers several factors and are found at Section 452.330 Revised Statues of Missouri.

The factors include the following:

  • Who contributed to the acquisition of assets
  • The conduct of each spouse during the marriage
  • The value of “non-marital property” (or property that is exempt from equitable distribution)
  • The custodial arrangements any children under the age of 18

Certain property is exempt from equitable distribution division. “Separate property” includes assets that one individual acquired before the date of marriage, and assets acquired through gift or inheritance.
